1. Agreement

By accessing or using BigImg (bigimg.ai), you agree to be bound by these Terms of Service. BigImg is operated by INFINITY LABS LIMITED (NZBN: 9429052298936), registered in New Zealand. If you do not agree to these terms, please do not use the service.

2. Description of Service

BigImg provides AI-powered image processing tools: image upscaling, background removal, and watermark removal. Free users receive 10 image processes per day. Paid subscribers receive higher limits based on their plan.

3. User Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old to create an account.
• One person may not maintain multiple free accounts to circumvent usage limits.

4. Acceptable Use

You agree not to use BigImg to:

• Process images that contain illegal content, including child sexual abuse material (CSAM).
• Remove watermarks from images you do not own or have rights to modify.
• Attempt to reverse-engineer, scrape, or abuse the service.
• Resell access to the service without written permission.
• Upload images that violate the intellectual property rights of others.

5. Intellectual Property

You retain all rights to images you upload. By using the service, you grant INFINITY LABS LIMITED a limited license to process your images solely for the purpose of providing the requested service. We do not claim ownership of your content.

6. Payments and Refunds

• Subscriptions are billed monthly and automatically renew unless cancelled.
• You may cancel at any time; your access continues until the end of the billing period.
• We offer a 7-day money-back guarantee for new subscribers. Contact support@bigimg.ai within 7 days of first payment.
• Cryptocurrency payments are non-refundable due to the irreversible nature of blockchain transactions.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We are not liable for losses caused by service interruptions.

8. Disclaimer of Warranties

BigImg is provided "as is" without warranties of any kind. AI processing results may not always be perfect. We do not guarantee the accuracy or quality of AI-generated results.

9. Limitation of Liability

To the maximum extent permitted by New Zealand law, INFINITY LABS LIMITED shall not be liable for indirect, incidental, or consequential damages. Our maximum liability is limited to the amount you paid in the 30 days prior to the claim.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time by contacting us at support@bigimg.ai.

11. Governing Law

These Terms are governed by the laws of New Zealand. Disputes shall be resolved in New Zealand courts.
